I'm getting married in July and my lease runs until June so my fiancee and I decided to move out early in March after finding a great place. The $ that I am referring to is not a security deposit but the last month's rent that I had to pay because I had given under 90 days notice of moving out. The landlord said that I had to pay rent on 2/1 if they had not found someone to move in by 2/1 but I would be reimbursed if a tenant had been found.
With full knowledge and approval that we are moving out in 45 days, the landlord put the apartment on the market and told me that once he receives a signed lease and a deposit on the apartment from a new tenant he will return the last month. After that date came and went, he informed me that I will receive the money at the end of the month. Then when that came and went, he changed the terms and said that I would receive the last month after "I leave the apartment the way I got it."
After moving out from my apartment, my landlord has not yet returned my money. Though I cleaned the apartment, puttied nail holes, and scrubbed the refrigerator, he is claiming that the apartment is not up to his standards and that he is going to hire a professional cleaning crew to clean the place. When asked if he will be taking the cleaning out of our check, he did not confirm but rather said "I'll have to sleep on it." I have not yet received a check from him.
What should I do in this instance? Is this the industry standard? I know that he had the apartment professionally cleaned before I moved in and when I moved in to my new place the new landlord had THREE people at the apartment cleaning. Should the previous tenant be expected to clean the apartment upon leaving in order to receive a refund for their last month? Am I the only one that thinks this is bullshit?
