I'm in upstate New York.
My refrigerator keeps breaking. My landlord will come and fix it to the point of it barely working for one to six months. I have repeatedly asked for it to be replaced. When I ask he doesn't say yes or no, he'll say that he's fixed refrigerators before and that they've worked afterwards.
I would like to buy a replacement and take the money out of my rent. Will I be likely to lose if he takes me to court over this? Is barely "fixing" the refrigerator the end of his legal responsibility?
Is he liable for the loss of my food? Can I justifiably take the food costs out of my rent?
The refrigerator was in the house when I/my roommates moved in so it's my understanding that it is an appliance he is responsible for. If I buy the replacement does that remove his responsibility to maintain the new refrigerator?
