My wife (and I) bought a fancy ($3000), used refrigerator at a seedy used appliance store in Akron, Ohio for $560.43 (including tax and delivery). It came with a 30 day warranty. It was delivered the day we bought it. *The delivery man stated that he had delivered this refrigerator to two different customers who each had returned it. After it was delivered I hooked up the water and it leaked. I called the store and they sent a repair person who took the broken water valve and filter. Shortly after I realized that the refrigerator had never gotten down in temperature. It had always been between 55 and 65 degrees. We removed all food from it and switched back to our old refrigerator. I called the store and explained the problem to the clerk, repairman and owner. I called them repeatedly; they made promises to call back and send a repair person but never returned calls or sent a repair person. For the only time in my life, I cancelled a credit card transaction. The CC company gave me a full refund.
The refrigerator has not been usable for a single day and has been sitting in my garage since March. The store never contacted me. At this point I either want to sell it off as is, or possibly gamble on having it repaired. It might cost more in repairs than it's worth; in fact I bet that's why the store never did anything to get it back.
Can I legally sell it or fix it and keep it? Who owns the fridge?
