I got fucked over on Craigslist, do I have a small claims case? legaladvice

Hi there!

So me and my roommates bought a kegerator (mini refrigerator) off of craigslist, and on the CL ad it was described as "like new", "perfect condition", "running great". When I picked up the kegerator (paid 350$), I saw that it had a hole drilled into the side. I asked the guy and he said that it was for running a CO2 line HE HAD DRILLED and that it worked great and most importantly assured me that it got cold.

Well I bring it home and turn it on, and immediately see a fine mist spraying out of the hole. It turns out that he had drilled a 1 inch diameter hole directly through one of the small copper coolant lines. Needless to say, the fridge does not work whatsoever. Im almost positive that this dude fucked up the refrigerator, and in order to recoup his losses sold it to some chump (me). I talked to him yesterday and he offered to pay me my money back, but today he said he will only give me half.

My question is, if I take him to small claims court - do I have a case? I have proof that he said it was working, and it is obvious that he sold it knowing that it did not work, due to his own doing.

PS, I dont know if it matters - but the coolant the line was spraying was most likely frion, which is toxic. Me and my roomates breathed that in for an hour. So he put us in harms way and I was just lucky that I caught it.
