I was employed at a small computer repair shop in upstate NY. The reason I took the job was because I lost my tech support job and desperately needed to find work, so I jumped at the opportunity to get back to work right away.
The owner kept saying he was going to put me on the books. He is a temperamental fellow, asking him to do something he promised to do earlier is like poking a bear. So I would back off, but would remind him about once per week.
Fast-forward four-and-a-half months, and he decides that he wants to cut payroll and run the shop himself. He said I can still file for Unemployment Insurance from my previous job, but I would be the one lying (I would need to say I never worked at his shop). I am extremely uncomfortable lying about something that could make me a criminal.
I need money. I am down to my last $80.
In addition to the loss of my job, he also shorted my pay by $150.
Oh, and he once pulled his gun out and threatened me (jokingly, according to him) for taking the last soda from the refrigerator.
I also fell and hurt my shoulder a couple of weeks ago while trying to clear the ice and snow from the front entrance. He laughed when he watched the video.
Can I get into legal trouble for working under-the-table? Can the owner? He was kind of a jerk, but I don't want to take his business down for that.
