The only language in my lease about inability to provide posession is in the event of something happening that is out of the landlord's control, such as a natural disaster, major repair issue, etc. My landlord still has not connected the water or placed a refrigerator inside the unit, which is a freestanding house. He is expecting a full month of rent, although the unit will not actually be move in ready until the 5th. He is claiming that he thought we were moving in on the 5th, even the move in date on our lease is for the 1st, which is the cause of the delays. I think this is a load of bull.
He also claimed that certain repairs would be completed when he took our money on August 11th. So he's had two and a half weeks to turn on the water, get a refrigerator, and make these repairs, and absolutely none of this has been done.
I am going to offer him prorated rent for the 4 days the unit was not able to be moved into, which amounts to just over $100 less than a full month. Is this legal for me to do? Thank you very much.
