(I've put UK/US because I'm in the UK, but would want to sell/distribute my product in the US)
So I know Disney doesn't own the Copyright to the Snow White and the Seven Dwarfs story, but they own the Copyright to THEIR version of it.
I'd like to make a video game about the 7 Dwarfs. I've came up with new names which are completely different from the Disney versions. My plans are for the story to be dark, gritty and tragic. So even at first glances you'll see it's not the magical colorful fairy tale land in the Disney version.
So I feel relatively safe about telling a story about 7 different dwarfs.
But I would like to include Snow White in the game.
Again, the story of Snow White and the Seven Dwarfs is in public domain. And my version will have only reference the original version written by The Brothers Grimm. And nothing in common with the Disney version other than The Brothers Grimm connections.
However Disney has the Trademark "Snow White" in pretty much every field. Specifically:
IC 009. US 021 023 026 036 038. G & S: Audio and visual recordings featuring live-action entertainment, animated entertainment, music, stories, for children; video game cartridges and discs; video game software; consumer electronics for children and accessories therefor, namely, cellular telephone cases, and face plates for cellular telephones; decorative refrigerator magnets.
I don't want to include "Snow White" in the title. But does Disney owning the Trademark for "Snow White" mean I can't even use it at all in the game? As a Character name, or in Dialogue, etc?
