Hotel frig froze and ruined expensive insulin (Georgia, US) legaladvice

I placed insulin pens in a refrigerator in a hotel. Within an hour or so, they froze, as we discovered when getting out a water bottle placed there at the same time, which was also frozen. Frozen insulin cannot be used and I had to get a new prescription. The insulin is expensive, about $1000 to replace (minimum prescription), plus I've had to do without my insulin for the next day since the pharmacy had to special-order it.

The hotel is saying it was my fault for not checking the temperature setting on the frig, and is trying to deny a claim. I have no pics of frozen insulin but I do have records of calling the doctor for a new script, calling the insurance company to get a replacement, and the local pharmacy to get the replacement. Insurance is covering most of the cost (I have another $30 co-pay) but it seems unreasonable that my insurance has to cover it and not the hotel's. What can I do?

I owe my roommates money. They sold my personal belongings. (VA) legaladvice

I posted something earlier, but I wanted to clarify, and give more details.

Back in August of 2017 I had a falling out with my roommates. It's difficult for me to communicate when something bad happens in my life. I have depression, anxiety, and am on the ASD spectrum. So when something difficult comes up, I just shut down.

I lost my job, but didn't tell my roommates. I would go out looking for jobs during the time I should of been working. Eventually they found out. They were mad, and rightful so. When they found out, while I was out of the house. they packed a suitcase with my clothing of mine and toiletries. They confronted me, took my keys, and made me leave the house. My name is on the lease. So they can't really make me leave.

During the time I was out of the house I stayed at a hotel for two nights. Eventually I contacted one of my roommates and apologized for my actions. I asked to come back to the house. They allowed me to do so, but under a agreement that we made via email titled, "Living arrangement prototype".

Before I get into the agreement we made. I just wanted to inform you that I owed them money for a debt that they helped me out. It was a verbal agreement. I was making payments to them, to pay off that debt at the time.

The agreement was that all of my belongings were to be held by them except clothing and toiletries. None of my belongings were to be used by my roommates. A 20% interest was to be added to my already outstanding debt at the first of the month. I had to pay rent of course. 1 months rent after moving. I had to pay a back cost of 25% of utilities since May and until present. I wasn't being forced to pay any utilities. I was working a minimum paying job while they way higher paying jobs. We had a mutual agreement about the utilities. If I failed to pay anything on time, I had to pay a 10% "good faith" weekly interest. I had to live in the unfurnished basement. I was not allowed to be anywhere upstairs unless approved. I had to notify them if I was going out or using the bathroom. A old refrigerator and microwave were supplied to me for my own separate food. I had to be out of the house 4-8 hours a day. They eventually made it 6 hours. I had to clean the house 2 hours a day. This was changed to 3 hours a day.

I spent two months in that basement. I was having a hard time finding another job. The unemployment I was receiving wasn't covering my expenses. I was living on one meal a day, eating basically Ramen. I had to deal with my roommates verbal abuse. My mental health was at a all time low.

I eventually contacted my mother to let her know that I may be coming to Maryland to stay with her. I wasn't sure when. During that time, my phone got shut off. My mom got worried because she had not heard from me in a couple of days. Eventually she contacted my roommates. They were furious that I was going to leave. Thinking that I would not pay my debts. They took my car keys from me. Told me that I couldn't get my car back unless I paid them $500.00. I also had to get out of the house. I was forced to sign my car title under the seller part. I felt threatened, even if it wasn't implied. For the final week I was there. They added a lock so I couldn't go upstairs unless I was approved. There was a basement door to the outside.

I left the house in early November. They threatened to sell all of my personal belongings, if I didn't pay them 10% by December 1st. Which was apparently almost $5,000. My dad paid them $500 so I could get my car in mid December. I have been unable to make a trip down there because of money. I would have to take a train. My parents refused to help me go down to Virginia.

I have been informed by my ex roommates that the majority of my personal belongings have been sold. A TV, furniture, misc books / DVDs have not been sold. As well as clothing I had to leave behind.

What can I do at this point? I have caused a lot of this myself, because I don't stand up for myself.

[Ohio] Our electricity surges daily and our landlord has known and ignored it for a year. Any options as renters? legaladvice

We all have custom built desktops that we do a lot of intense and time consuming work on for our schooling. If the washer gets turned on, they shut off. If the dryer starts, they shut off. If the heat/AC turns on, they shut off. If the refrigerator eventually gets enough juice to kick on, they shut off. If we switch on the garbage disposal, they shut off. Our microwave gets so little electricity that it takes 20 minutes to heat leftovers, and does not pop popcorn, tested by two microwaves. It has been an issue since January of last year. It has steadily worsened over the year, and all that has been done is the sending of an electrician to look, which was several months ago. Our emails get repeatedly ignored. Do we have any options?

I had a terrible experience with a cleaning company. What are my options without breaking the law? legaladvice

Tl;dr; An awful house cleaning company in Pennsylvania missed appointments, broke promises, and then BARELY cleaned the house after making sure I couldn't be there to ensure proper work was done, and I'm stuck with paying. What can I do?

Full story:

I had a line in my lease agreement that when I moved out, I had to pay for a professional cleaning because I negotiated a change in the pet policy. The landlord is fantastic and understanding throughout the ordeal, he's not the issue.

I hired this company based on the price and the reviews on Yelp. They missed my appointment which was made for the day before we left to move out of state, then we called and rescheduled, but they missed that appointment as well so they had to come while we weren't there, because we had already moved out. We rescheduled a third appointment, asked if they did the inside of the fridge (they did), and arranged for before and after photos to be taken since I wouldn't be present. These photos never were taken.

Then they forgot how many work hours I scheduled in the original appointment booking, and texted after they went over the agreed on hours. I am not being charged for the additional hours, fortunately.

Then the owner asked me how I'd like to pay, and I told him I'd mail a check once my landlord reported that the work was done. This was accepted. I sent out this message to the cleaner to complain about my experience, which details issues I glossed over:

So to review my experience with your company:

  1. You didn't return my first voicemail.
  2. It took 4 days to reach someone by phone.
  3. You missed our appointment Monday.
  4. You missed the rescheduled Tuesday appointment without a call or text.
  5. You forgot how many hours I had requested.
  6. You didn't contact me to clear up the hours you forgot until after you had begun work.
  7. You didn't take pictures as you had said you would since I wouldn't be there to see your work.
  8. You didn't reply to my request for the photos for 2 days, and I had to ask again.

The owner apologized and then asked again for payment.

Then I asked my landlord if the work was done well, and this is our conversation:

Hey [landlord's name]. Wondering if you've been through the place since the cleaning was done?

Yes several times. To be frank they did a pretty bad job. But im not worried about it. U guys were great tenants. As soon as the 1st rolls around and technically the lease is over ill mail out the deposit.

Could I trouble you to give me some specifics about their work that I can report back to them when I complain?

Yup. Baseboard really wasn't hit, there was still pet dander on floor and it looks like there was tracks from salt and shoes, i expected a better cleaning in the bathrooms especially the grout and caulking areas really weren't touched as they tend to be the most dirty, laundry room didn't look like it was hit. I will say the refrigerator was nicely done and the kitchen. Oh and front and back door they didn't hit the glass.

Based on this assessment, they barely cleaned anything. The house was barren of all items, they only really had to clean the floors and bathrooms, and barely did so. They cleaned the fridge that I specifically asked about, and just did a quick wipe and left after tracking in additional salt from the roads.

So now I'm stuck owing payment to a company that was awful to work with, and did the BARE minimum to say they came in and cleaned.

What are my options, besides just paying them full price and being done with it? Needless to say, I'm rather angry that they can get away with this, especially since it was their fault that they were able to do the work while I couldn't supervise or check the work. I'm especially upset because I can't say they didn't do the work at all, because they clearly did show up and make an attempt.

Received collections bill for last apartment's management company legaladvice

I moved out of my apartment in Seattle last September. There was one thing in the apartment that I knew would be taken out of my $500 damage deposit and a cleaning fee. A couple of months after I moved out I was wondering when I would be receiving the remaining balance from my damage deposit, so I called the office and they said they would email me the invoice. They sent me an email saying that I owe them another $554. One of the things listed on the invoice is a replacement cap for the shower drain...they said this cost them $100 and more for labor. The problem is that this shower drain piece was never there in the 4 years that I lived in this apartment. I did not know to list it on the move in damage walk-through sheet because it wasn't there in the first place. And now they want to charge me for it. Also they are charging me $150 for the broken shelf in the refrigerator that was broken when I moved in. I put a work order in to get the refrigerator fixed, but they told me the refrigerator company needed to fix it and that they would be out later in the week, but I never saw them and the refrigerator was never fixed. I didn't put in another work order because my landlord was mean and made strange inappropriate comments and pushed my boyfriend once and I didn't want to deal with him. Also, I have no record for the work order because their work order system at the time consisted of a 5"x8" piece of paper that you slid under the door of the shitty landlord. So after I received this invoice from the management company, I sent them an email and stated my concerns for these charges. The woman in charge of my building said that she would get back to me as soon as possible and she never did. And now, just today, I received a bill from a collection agency. So my problem is that no one ever contacted me about this invoice, even though they had my forwarding address. And if they would have sent the invoice to my old apartment, USPS would have forwarded it to me. But no one let me know I had an outstanding debt until I contacted them. Is that illegal? They told me they would follow up with me about my concerns and no one did, and now the bill is damaging my credit. Can I take them to small claims court? Do I need more evidence?

It's just a big corporation trying to screw me out of money. It's not much, but I don't want to pay it out of principle.

Thanks for the help and my apologies for the grammar.

Chicago - can't access fuse box legaladvice

Last night at 7:30 a breaker switched off (apparently I can't run the dishwasher and microwave at the same time...) and power shut off to the refrigerator and half the apartment. I'm in a 3 story building with roughly 30 units.

I immediately called the management company (Becovic) and kindly informed the after hours people and they would send someone out. Nobody came. Called again an hour later. Nobody came. I called 4 times before I took the freezer stuff and put it outside because it's luckily 18 degrees out and went to bed.

I called again this morning at 6 and was basically told it's "not an issue on their urgent list"!!! their website claims 24/7 urgent maintenance service. It's now 8am and I'm going to be at least an hour late for work.

I know Chicago municipal code says I should have 24 hour access to fuse box and if I don't then the on-duty staff needs to give me access. The room is behind a padlock in the basement.

What are my options? Can I make them reduce rent for spoiled groceries?

[CA] Owner-supplied fridge malfunctioned, leaving me with an extremely high electricity bill. What are my rights? legaladvice

Thank you in advance for reading. I rented a studio apartment as a work space and about 3 mos into the lease suddenly my electricity bill spiked. I have a 2 bd apartment as well that's about 3x the size so I could compare the kw/h usage between the two and the studio was using an INSANE amount of electricity (see below), especially considering I'm only there 5-10 hours a week. I figured out the only appliance that runs all the time was the fridge, so I unplugged it and the usage returned to normal.

I've done some looking around online and all I can find are opinions about who should pay it, not who's legally responsible. In the lease, the tenant pays electricity but the owner provides/owns/repairs the appliances. I had decided to drop the issue of the fridge at the time because I didn't care enough I suppose, but since I'm giving up the apartment soon I want to make sure I am not leaving any money I am entitled to on the table.

I wrote the owner this email 28 May 2017:

The refrigerator in [address] has yet to be replaced, leaving my only option to leave it unplugged since we spoke last at the end of March (I have communicated with the on-site manager letting him know he is free to enter my apartment and replace it at any time, with minimal notice) No other change has occurred related to my use of the space or electricity, and at your and the DWP's recommendation I have confirmed the meter readings are correct.

As a result of my unplugging the refrigerator, the kwh usage in my unit has decreased from 1566 (12/07/2016 - 01/25/2017) and 2785 (01/25/2017 - 03/24/2017) to 440 (03/24/2017 - 05/23/2017), a percent change of about -85%. I've attached the utility documents here for your review.

As we discussed in late March, my DWP bill was $284.05 for the period ending 01/25/2017 and $528.85 for the time period ending 03/24/2017. The bill for the most recent period, ending 05/23/2017 is $76.15, a difference of $452.70 bill over bill.

This note is to request reimbursement of $578 for the excessive charges caused by the faulty appliance and the disruption of not having a working refrigerator in the unit for 2 months. This amount accounts for, and does not include, the initial set-up fee charged by DWP for new service and the difference in # of days in the first billing cycle and the most recent.

Is there anything else I can do? The manager did not respond to this email and claimed to be in the hospital when I sent it.

Seattle Landlord making me pay for cleaning legaladvice

Hello everybody, I feel like I’ve read so many posts like this but I️ can’t seem to find any now that I’m loooking for one. Maybe y’all can help me. So I rented in Seattle for a few months and my landlord was very hands off to say the least. After i moved out, i didn’t receive my security deposits/itemized deduction until today (1/12/2018) and i moved our December 1st (12/11/2017). I think not only was he suppose to get this to me by 21 days after i left but he is also taking my entire deposits and asking I pay him $50? He wants it for cleaning which i did throughly before i left. He wants 100 to clean the oven, 100 for the bathroom 100 oven/stove and $50 for damage to the refrigerator, and 300 for removing some items I️ left there (which I️ did but I️ don’t think it would cost that much to do) There are no actual receipts for the cleaning it’s just something he typed up. What are my options?

New renter of a private apartment in Illinois, looking for breaches of contract on landlord's behalf. legaladvice

Hello, /r/legaladvice. I am a first time renter in Morton Grove (in Cook County). I signed a lease that began on January 1, 2018, and from the get go, I have been unhappy with my landlord. On January 1, I was promised a fully remodeled and cleaned apartment. When I arrived to pick up my keys, I found that the apartment was not finished, nor was it cleaned. There was no stove installed in the kitchen (but one was promised in the contract) and none of mess from the construction workers (sawdust etc.), nor the prior tenant had been cleaned. I took photographs of the mess and the lack of a stove, posted them to an Imgur album, and wrote an email to the landlord (cc'ing my roommate) documenting the state of the apartment, and highlighting the clause in the contract promising a cleaned and finished kitchen. I received no response, so I called the landlord the next day. He told me he replied to the message and that they would send someone to clean the unit (they did) the stove would be delivered and installed on 1/3 (it was), and that they would not charge me rent for the days which the apartment was uninhabitable. The issue here is that the email the landlord said they sent was never received by me or my roommate. On 1/3, my roommate and I took possession of the unit and began to move in. We did not spend the night of 1/3 there, as we had not moved enough items in. On 1/4, our first night, we noticed that the refrigerator and freezer were not cold. I sent a text to the property manager, and he told me the unit would be delivered and installed on 1/8 (it was).

I have been unhappy, but tolerant about these issues. My real issue lies with cigarette smoke in my apartment coming from the neighboring unit. This neighbor spends all day in their apartment chainsmoking. I brought this up to the property manager today (1/9), and he said there is nothing they can do about it. This apartment was not advertised to us as a smoke-free apartment. The below evidence is my attempt at coming up with a legal argument to have a right to not be exposed to this second hand smoke.

In our lease, there is a clause under the 'Rules and Regulations' section that states the following:

No activity carried on within the Premises or common areas of the property will be permitted which threatens the health, safety or property of any building occupant, or of Landlord.

In doing some googling about my situation, I found the following clause in the PUBLIC HEALTH (410 ILCS 82/) Smoke Free Illinois Act via http://ift.tt/1LKPEZ8 :

The General Assembly also finds that the United States Surgeon General's 2006 report has determined that there is no risk-free level of exposure to secondhand smoke; the scientific evidence that secondhand smoke causes serious diseases, including lung cancer, heart disease, and respiratory illnesses such as bronchitis and asthma, is massive and conclusive...

To me, this states that the state of Illinois recognizes exposure to secondhand smoke as a health risk. I have yet to bring this up with my landlord or with the property manager, but I would like some advice on this part prior to approaching them.

In general, I am unhappy with the property; how it was presented to us and how we have been treated. I am wondering if any behavior or actions I have taken have voided my ability to break the lease, or if that option is still available based upon evidence above. Thank you for your help.

Wrongful termination in New York City? legaladvice

Hi all. I was recently fired from a company I've worked at for 6 years. I've had virtually no issues other than being late a handful of times. I was fired under the terms of being "being violent" with another coworker. Me and this coworker haven't really got along in the past. A week before I "was violent with him," we got into an argument and things have been tense ever since. HR knew about the argument and was well aware things were tense. I work in a restaurant and the space is pretty tight and I had accidentally brushed shoulders with him as I was going to grab supplies to restock our refrigerator. He went to HR saying I elbowed him 3 times and got two of his friends also working that day to write witness statements backing him up. There's no security camera footage of the incident, just their word against mine. They've been know to gang up on people they don't like before. To me, it's pretty clear that this is retaliation. Sorry if this is all over the place, I'm still in shock that I'm dealing with this. Do I have a case here, or should I move on?

Concrete laborer out of work but company refuses to lay off legaladvice

First things first, this is a long story. Secondly I'm writing from ohio. So to start I should probably mention I have no idea if I'm in a union or not. That sounds strange but hear me out. I was definitely not in a union before I got an offer to work with this company they hired me on via referral and I started the next day no mention of anything union. I show up to sites and everyones wearing 310 laborers union and 17 ironworkers etc patches so I turn to the guy who reffered me and he confirmed that everyone in house is union when I got my first pay stub I noticed theyre taking out a sum every week for what is labeled "union" mind you I have never taken a drug test signed any books taken any apprenticeship classes of any kind I'm just a guy who knows how to do stuff. I havn't made a stink about it because the money is good and I'm a fan of having food and beer in my refrigerator. They currently pay me at the top end of a laborers pay scale. I mean I'm worth it but from what I understand you typically have to work up to that sort of thing. So I don't really want to screw this up because the money is good when I'm working. But on the other hand I'm fairly certain I don't have benefits/pention/PTO protections/anything union workers get. If I call up the hall are they going to investigate and ruin this cash cow for me?

But back to the matter at hand. I have been out of work for about 2 weeks now and I'm not getting any kind of heads up as to when ill be going back. This typically happens every winter when you work concrete but the problem is not so much I'm not working its more that they havnt laid me off so I can apply for unemployment/ know that I need to find other work. Currently my fiance is paying the lions share of the bills because I'm only working weekends to keep my availability open. Typically they call the night before or sometimes the morning of for work. So my question is this; Can I just file for unemployment anyways without a notice of being laif off, or am I stuck waiting at the mercy of the weather or some bozo in the office to relieve me?

Tldr; No work but no layoff keeping me in limbo draining bank account, and union dues being taken but no union protections.

Former landlord claiming excessive damages after moving out (Portland, Oregon suburb) legaladvice

I lived at an apartment for a year and a half and left the apartment in great condition, I also took a video recording walking through the apartment just before returning my keys. I cleaned counters, bathrooms, window sills, cupboards, vacuumed, everything you can think of other than shampooing the carpet because the lease states the landlord will have the carpet and professionally cleaned and bill the tenant no matter what (unless the entire carpet is being replaced). The lease also states that the expected lifetime of the carpet is 5 years and the expected lifetime of paint is 2 years.

When I received the final statement they stated they were not only keeping my $349 deposit but that I owed an additional $470. They itemized the costs as light cleaning ($80), carpet replaced in living room due to pet damage ($487), carpet cleaning in bedrooms with pet treatment ($105), touch up paint of 2 gallons ($26.25, 2 gallons wtf?) and the remaining charges itemized under 3 categories for final utility payments ($120.69).

I replied that I accepted the charges for the final utility statements and the carpet cleaning but I was disputing the remainder of the charges. For the cleaning charge they replied with pictures showing a small amount of lint in the dryer vent, a few splotches under the vent fan area above the oven that I missed and a small amount of dirt between the oven/refrigerator and inside the windows. For the carpet replacement/cleaning charges they sent photographs showing three small stains no larger than the size of a business card or so only visible with a blacklight. For the paint charge they gave pictures of about a half dozen barely visible marks on a few walls (literally not much bigger than the size of a pin head).

I filed an appeal with the Better Business Bureau which they replied to with the same canned response I got from my initial dispute that I communicated via e-mail. I've rejected their resolution explanation and demanded a return of the difference between my deposit and the charges I accepted but the date I set has come and gone (December 31, 2017). They seem to have gone silent since my last BBB reply but they were threatening to send the amount they claim I owe to collections, do I have any recourse here? Should I just let it go to collections and then dispute the validity of the debt? I have plenty of money to pay the charges but I'm not going to be bullied into paying something I don't owe. Thanks.

[California, US] Bought a fridge from Sears. Ice maker has not worked since. They won't replace our fridge or give us full amount for what we paid for it. Can we take them to court? legaladvice

So we bought a kenmore fridge from a Sears store and it as delivered Sep 30th last year. Since then, it has made no ice. We've called Sears "customer service" since we paid for the extended insurance on the fridge so that a tech can be sent out to fix the problem. Out of the 5 appointments we've made, 3 of them no one showed up. And each time no one showed up, we had to take the day off work because their techs only work between a time frame of 10-5pm but because their daily work can be sporadic in nature, when they arrive is completely up to them. The 3 times nobody showed up, we weren't contacted at all. Their customer service line, who just loves to reschedule no matter what you're calling about, said they showed up and nobody was there but that's bullshit because we were physically at home waiting. So after being lied to 3 times, and the offshore reps reading scripts back and forth to us over and over, we complained enough to get a hold of their escalation department in the US. After this point, we made 2 more appointments and techs arrived each time.

The first time the tech came to replace the actual ice maker and said give it 24-48 hours to make ice. Nothing...

The second time the tech came to replace the valve and said wait 24-48 hours. Nothing...

And now we've been scheduled for a 3rd time to what the last tech said is, "the only component left that we can replace for this particular issue: the computer board". That appointment was made 2 weeks ago for tomorrow and guess what... the part wasn't ordered -.- So we have to hope to god that the tech coming tomorrow has a spare computer board for our model fridge. If not, they'll have to order the part and reschedule, which means another day we have to take off work.

We've called over and over to complain, asking that they replace our fridge because we paid for one to have an ice maker but they keep trying to give us the run around.

"Well Sir, if the refrigerator is cooling on the inside and the freezer is working, the refrigerator isn't the problem." So I tell them "according to their techs, if the last and final part that can be replaced for the ice maker won't fix our issue and our refrigerator won't make ice, and that's a core component and feature we paid for when we chose the refrigerator, then that's not true." but they just gave me attitude and said well too bad. And when I pushed them over and over about replacing our fridge, they said even that were to happen... Sears would give us a "valued amount" for our fridge and not even what we paid for, which doesn't make sense.

So now I want to pursue legal action against Sears for selling us an item that doesn't fully work and even their techs aren't able to fix. In fact the last tech that came over said we had bad luck because the Kenmore fridge we bought is technically manufactured by another company and the model number starting with 00 means these have had many issues....

What can I do about this? How would I have to proceed. Do I have grounds to pursue legal action against Sears?

TL;DR: Bought fridge from Sears. Ice maker hasn't worked since delivery (3+ months). Techs have replaced 2 parts with no luck. Sears giving us the run around and won't replace our fridge.

The floor of my new apartment was damaged after i signed the lease [CA] legaladvice

on December 28th Signed for a new apartment in Los Angeles. I requested that they remove a refrigerator because I had my own. on December 30th I went to the apartment for the first time since I signed to start moving my things. there was a huge scrape across my hardwood floor. It looks like it was from when they dragged the old refrigerator. I took pictures and emailed them to management asking them to note that I did not cause it and to please repair it. Management has not responded to me yet. i have a few questions.

  1. what is reasonable to expect?
  2. i would have never signed a lease if the floors looked like this could i get rent reduction based on how unsightly it is?
  3. how long is it reasonable to wait for them to fix it.? 4.if they try to say i caused the damage what do i do?

Thanks!

Detroit Area - Rental house, one room unbearably [uninhabitably] cold. Looking for advice. legaladvice

So I've posted this over at /r/tenanthelp as well, but that sub doesn't seem incredibly active, so I'm posting here as well. Hope that's cool.

So I have been renting a 2br house a bit northwest of Detroit. It's sort of a dumpy place, built in the 40s and not well maintained. I pay 1310/mo for it, but i'm sure I'm paying largely for the location.

I had the desire to move in to a house because my girlfriend and I had a child and wanted more freedom than an apartment gave us.

We checked it out in the early fall, and although it was a higher rent than I wanted to pay, it checked off all our boxes and had this extra back room off the kitchen that sold us - it's sort of my workshop/man cave + cat area. Perfect, I thought.

We move in around Thanksgiving and then winter hits. The house is so damn cold all around, but this back room is like a giant refrigerator. Air coming in from baseboards, from gaps in drop ceiling, from outlets, etc. If I keep the heat on in the house all day, @67 degrees, on a cold day, that room will get no warmer than 40-45 degrees.

It's part of the house, it was the part of the house that sold us on the rental. I really intend to use it, and it's not sealed off from the rest of the house, so I pay up the ass to heat it.

I spent time and money trying to fix it just enough to deal, but I end up having to run my electric heater down there for an hour or two to bring it up to a hardly reasonable 55 degrees.

I've complained before and they've sent a building contractor [literally the worst contractor I've ever encountered. I am shocked he had a license.] to try and seal up the leaks and replace the drop ceiling tiles.... But he did nothing but make it worse. [This guy cut the new ceiling tiles.... so a total of zero of them actually fill up the whole space now.]

I pay too much for this place as it is, and I feel like I am being cheated. That room was advertised with the house, so I had to assume it was habitable. It's simply not.

Any advice on how to deal with this situation?

Thanks, guys.

Edit: /r/tenantrights > /r/tenanthelp. The former isn't a thing.

Signed lease, haven't moved in, many major damages in apartment. Is this breach of contract? legaladvice

I'm in Arizona. I signed a lease on 12/22 which took effect 12/23. Got to apartment on 12/23 and there was no doorknob on the front door and the area around the deadbolt is severely chewed up, like someone used a crowbar.

A doorknob was added to the door today, but the damage is still on the door.

Other damages include:

Front door:

damaged area by deadbolt, security risk

Kitchen:

Garbage disposal not working, makes very loud grinding sound

Cabinet doors askew or don't close

refrigerator doesn't get very cold

drawers loose and damaged with cuts, holes etc. Some fall down when opened.

Front bathroom:

needs doors for medicine cabinet

shower door needs handle

Master bath:

shower doors need a handle and currently won't open.

needs doors for medicine cabinet

toilet lids loose where connected to toilet

most tiles in shower are broken

master bedroom:

ceiling fan needs chain for light

closet doors fall off track when opened

all blinds:

slats are different sizes, many broken and facing in different directions

Can all this be considered a breach of contract? Or, what advice do you all have for me in this situation?

Landlord kept deposit, charged for items such as housekeeping and bent rails in refrigerator. legaladvice

Here goes. I moved out of an apartment in Phoenix on November 08 of this year. On the 8th, we were at the end of moving the last boxes and cleaning. We asked the manager to go a walkthrough with us prior to handing over the keys back. The manager didn’t want to, so we told her that we had a right to be there at the walkthrough and asked when it will happen. She, the manager, hesitated but sent the maintenance guy to do it. We went through, he told us he would charge us for items like cabinet door replacement, wall needed to be resurfaced and painted, light bulbs and drip pans on the stove. So we knew what we expected. It was around 5:45 pm in the evening and the manager demanded the keys by 6 pm or else she would charge us for another day. A little backstory, the manager didn’t like me as she try to evict me prior and violating the lease for not notifying we have pets and putting a deposit down and pay pet rent; this is true for dogs and cats, but birds are not part of the pet part of the lease. Our complaint went all the way to corporate and I’m assuming she got into some kind of trouble from her boss. So, this ticked me off and just complied with here. We changed the light bulbs that were burnt out and replaced the drip pans.

Fast forward to last week, I finally get a letter from the apartment complex assuming I was going to get at least part of my deposit back. My $400 deposit was held and now owe $365. I get a call on a Friday evening and it was my old manager demanding payment right away as I tried to question certain charges and dispute them, but she didn’t want to hear it and told me that I have 30 days to settle the account.

Since I was a renter in Arizona, does Arizona tenant rights allow me to demand my full deposit back? As the manager didn’t mail me my deposit/items owed with in 14 business days? The envelope was post marked on December 11, 2017. The letter demands payment be made in 30 days by January 11, 2018 before being sent to collections.

tl;dr moved from apartment complex, manager used entire security deposit and charged more, did manager violate the 14 day rule by mailing deposit/itemized lists owe after the 14 day in Arizona.

Slip and fall legaladvice

I was at a major grocery chain tonight. Water was leaking from a refrigerator unit. I slipped and fell. My knee is very swollen, I'm visiting a doctor tomorrow due to toe numbness with my knee. I was also previously diagnosed with hip dyspepsia and now I have some pain with this as well.

A customer saw me and I got her contact info.

I mentioned to a store employee about the fall. He ended up walking away from me. I was pretty embarrassed so I left.

What do you all recommend? I'm in Denver Colorado
