I purchased a home. As part of the purchase agreement all appliances convey. Also, the sellers were allowed to stay in the home rent-free for a period of 9 days after we closed with a $500 security deposit.
This is about the refrigerator. We did a final walk through the day before closing and the sellers had not packed anything but nothing looked terribly different. Everything appeared in working order.
When the seller vacated the home we did another walk through. Not Clean! Ok, whatever, we did not necessarily specify that they had to clean the home on exit. BUT the refrigerator was leaking water. Upon inspection we realize it is the ice melting and that it is not cooling. The next day we notify our agent who notifies the sellers agent.
Are they obligated to fix the appliance that they contracted to sell in good working order? As of right now they are putting the burden of repair on me. I will have to coordinate the repair, pay for the diagnosis and repair and HOPE they pay me back... I would just rather they send someone to fix it themselves leaving me out of the transaction but they do not seem to want to do that.
