In December of 2013 I bought a kenmore elite refrigerator through Sears outlet with dents (at a nice discount) and have had constant problems with it ever since.
The repair occurrences look like this:
3-14-14
3-21-14
5-14-14
7-16-14
8-22-14
10-17-14
11-07-14
3-17-15 (next one I have scheduled)
Basically the ice fan in freezer keeps getting ice buildup and making a lot of noise until it completely stops spinning and then gets an error code, freezer thaws out, ice melts, etc.
I've been lied to, jerked around, and given endless excuses why they cannot replace it this time, but "you need to do it just one more time."
After the second repair I bought the extended warranty (master protection). When I first started inquiring about a replacement, they said I needed 3 failures of major parts. Once I had 3 major parts fail and were replaced they started making excuses that what I bought was "as is" because I bought it through the sears outlet. However, that was not the cause, it came with a manufacturer warranty and I had other people verify this. Even if it was sold "as is" they were still willing to take my money on an extended warranty and then start using excuses why they cannot do a lemon replacement after the fact.
On the 11-07-14 repair the freezer fan/heating element was replaced for the 2nd or third time and the technician found the last tech did not plug in the heating element properly. I really thought that was going to be it and it was just rank incompetence on the part of the previous technicians. However, yet again the pos is failing again (though 4 months later).
Now they are telling me that since I have not had an issue with in the last 60 days, they need another technician to verify another functional failure before they can replace it. But wait "Oh I'm sorry I just reviewed your history and you have not had 3 functional failures since you bought the extended warranty, so you need two more functional failures or the tech deeming it unrepairable before we can replace it." Problem is some of those repairs the tech just came out and melted the ice (temporary fix) and it didn't count as a functional failure. Nevertheless, I don't buy that they don't have enough functional failures on record from the time I got the extended warranty (why does that matter anyways?). I have had to personally throw away 3 of those massive fan assemblies because they won't take that crap with them when they leave.
I'm fed up and I'm wondering if I can peruse legal action against them? Perhaps small claims or something, I don't really know where to begin. In addition, I'm a full time college student with not a lot of money or time to be messing around with this. So I probably won't have time until the summer anyways. I'm hoping by then they will do what they said they will do, but they may pull the "Oh you bought this at the Sears Outlet.. i'm sorry.." bullshit again.
TLDR: 6-7 repairs in the past year for the same issue and they won't replace the frig. Can I do anything about this?
