I live in north Florida where leases run 12 months standard and as such as the biggest headaches to move with. We just signed a renewal form 6 months into my current lease (because this is how it is done here) and are leased until July 2016. My ac broke about 6 weeks ago was repaired and broke again 2 weeks later. I contacted the company and a repairman came out and said it had to be replaced and he could get it done by next week pending red tape. He also said the damage was because of the age of the unit. It has hit 80 degrees inside multiple times in my apartment. I am losing sleep and have lost fish from my tank getting overheated as well. I know its winter but winter doesn't exist in Florida some weeks and my least has conditions about this which follow below:
My lease states "10, Mechananical failure: The Landlord upon proper notice from the Resident shall have a reasonable time to determine the cause of any malfunction and to have the same repaired without any liability as to damages or inconveniences to the Residents, for that reasonable time period. This provision would include sewer lines, water heater, heating and air conditioning systems, refrigerators and appliances, but not exclusively. If the Resident or Resident guests cause damages or a maintenace problem beyond normal wer and tear, Resident agrees to pay Additional rent, within 5 days of demand, to reimburse the Landlord for the cost of repairs.
Jan 23-AC broke, repairman visited - I have screenshotted call logs for this.
Jan 30th- "Owner thinking" verbal no documentation
Today- No other contact since.
Do I just call and complain again? Do I submit a letter to fix or terminate lease? How long do I give them? Do I already have grounds to terminate and the letter isn't even necessary? What is "reasonable" time?
A lawyer is possible if it is the better choice.
My SO and I were on the fence about moving we don't really like the place (too small, neighbors are meh) but it has positives(locations, all the amenities we wanted and pets) and we did resign since we assumed positives >negatives but this is getting crazy. The housing here is hard to rent outside of August (leases usually run till then so it lines up with the semester) and I don't know how long we would have if we terminated to move out. I am somewhat worried about having a 1.5 years with them if getting something big fixed is already this hard. The fridge is old and if it dies, what then, based on the owners previous decisions. Suggestions?
