Questions about Security Deposit on old apartment legaladvice


So my lease ended on 9/15, and on 10/22 I got a bill for $228 from my old landlord instead of my security deposit of $500.


The bill had things like Blind Replacements, carpet replacements (damage from my dog which I'm not complaining about, but we'll come back to this) but it had a few things on it that I want to contest.


According to them, they had to Clean my appliances for a total of $150. I know I cleaned the ancient refrigerator and the ancient dishwasher before I left, and they were in good working condition. I never used their stove once, but they were too incompetent to take it away AND amend my lease saying that there's no stove (I had my own) so I just left it in the basement and replaced it when I moved out.


They charged me $25 for a jammed disposal, which I also cleaned out and I know worked because I used the rest of my garbage disposal cleaning things because I don't have a disposal where I'm moving.


They also are charging me $75 for a pet odor. I paid a pet deposit of $250 (non refundable) and monthly installments of $30. Pets have odor, that's what I assumed that fee was for.


Anyway, I'm willing to settle for getting nothing back if it means I'm done with them forever. But if they want to fight me for the $225 I'm going to take them to court for the preceeding and also for the carpet replacement cost because when we moved in there was some subfloor damage that they refused to repair. It started out in a couple spots but by the time we left there were some spots where we would step on and sink down about an inch or so. I'm pretty sure this is against code, and they cited the reason that they woudn't repair it is because they'd have to rip the whole carpet up and move us out until they fixed it.


I have the emails saying that they didn't fix it, and I have video showing how bad it was when we moved out.


Most of the lawyers I've called are asking for about $50 to even hear what I just said, but I don't want to pay them 1/4 of what I owe my old landlord to be told that I don't have any legal ground to stand on.


I regret not taking pictures of everything, and I doubt that they did either, but I haven't talked to them yet because before I start making threats about taking them to small claims court I want to have some ground to stand on and stuff.


I live in Rochester, NY. I've heard from a few people that the landlord only has 30 days after you move out to send you any bills as well, but I'm not sure how true that is.
